Terms of Service

These Terms of Service ("Terms") are an agreement between you and Nimblog, operated by its owner ("Nimblog", "we", "us"), governing your use of Nimblog (the "Service"). By creating an account or using the Service you agree to these Terms and the Usage Policy. If you use the Service for an organization, you confirm you may bind it to these Terms. The Service imports content from WordPress sites (export files or a live site you own) and hosts it as a website on our infrastructure. Features may change over time. Before publishing, you are responsible for checking that your imported site is complete and correct.

You must provide accurate information, keep your sign-in credentials secure and tell us promptly about any unauthorized use. You are responsible for activity under your account.

You keep all rights you have in Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transform (for example resize images or render HTML), cache, transmit and display Your Content solely to operate, secure and improve the Service and to provide your site to its visitors. This licence ends when Your Content is deleted from the Service, except for copies in backups kept for a limited period and content we must retain by law.

You represent and warrant that you own or have all rights necessary to Your Content (including all images) and to grant this licence, that you import only from sites you own or control, and that Your Content and your use of the Service comply with the Usage Policy and the law. Adult or sexually explicit content is not permitted.

Launch offer. The Service is free of charge for everyone, whatever the size of the blog, until October 23, 2027 (the "Launch Offer", 12 months from launch).

After the Launch Offer. Plans and prices as published on our pricing page apply. Subject to these Terms, blogs with fewer than 100 published posts remain free ("Free Tier"). Larger blogs will need a paid plan (currently announced: Starter $5/mo, up to 1,000 posts; Plus $10/mo, unlimited posts, up to 3 sites). Billing is not live yet.

Notice before any charge. We will never charge you without your agreement, and we will email you at least 30 days before any charge or any change that reduces the Free Tier for an existing site. Export of your content remains available at all times, including before any change takes effect.

We maintain the hosting, TLS certificates, software updates and content-sanitization measures of the Service and work to keep them current. This is a best-effort commitment, not a guarantee: no system is free of vulnerabilities or interruptions, and we do not promise that the Service will be uninterrupted, error-free or secure, or that content will never be lost. Keep your own copies of Your Content (see section 8).

Storage included. Each plan includes a storage quota for the media files of your sites: Free 100 MB per site, Starter 1 GB per site, Plus 5 GB shared by all Plus sites of an account. Usage counts the files as stored by the Service.

Optimized web versions, originals not retained. On every plan, images you import or upload are stored as optimized web versions: resized to at most 2560 pixels on the long side on Free, 2560 pixels on Starter and 3840 pixels on Plus, recompressed in the same file format, and stripped of metadata such as camera details and GPS location. The Service never keeps your original files, so keep your own copies of your originals.

Limits. When a quota is reached, new uploads and imports are refused until you free up space; we never delete your content because of a quota. New uploads and imports may also pause briefly while we add storage capacity. We may change quotas and image limits with notice as described in section 5.

You can export your content at any time from each site's Export tab, as a WordPress export file (WXR) and a zip of your media, including while a site is suspended unless the content is illegal or the law prevents it. You may stop using the Service and delete your sites at any time.

We may, at our sole discretion and without prior notice, suspend, restrict or terminate your account or any site as described in the Usage Policy (for example for unlawful, infringing, adult, abusive, spam, malware, phishing or scraped content), and we may terminate the Service for you for any other reason with 30 days' notice; in that case we will give you a reasonable opportunity to export your content first. Suspensions can be appealed by email to abuse@nimblog.com.

The Service and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy or quiet enjoyment, to the fullest extent permitted by law.

To the fullest extent permitted by law, Nimblog, its owner and its contractors and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or search ranking, arising out of or related to the Service or these Terms, even if advised of the possibility. Our total liability for all claims relating to the Service is limited to the greater of the amounts you paid us for the Service in the 12 months before the claim or 50 US dollars. Some jurisdictions do not allow these limitations, in which case they apply to the extent permitted.

You will defend, indemnify and hold harmless Nimblog, its owner and its contractors and agents from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Service, or your breach of these Terms, the Usage Policy or the law.

We may update these Terms and the Usage Policy. The version and effective date are shown at the top of each page. For material changes we will notify you in the admin or by email, and you will be asked to accept the new version before your next import. If you do not agree, stop using the Service and export your content.

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. This does not take away any mandatory consumer-protection laws of the place where you live, which still apply.

Before filing any claim, you agree to contact us at legal@nimblog.com and try to resolve the dispute informally for 30 days. Any remaining dispute will be resolved in the state or federal courts located in California, or in small-claims court where eligible.

If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service. These Terms and the Usage Policy are the entire agreement about the Service.
